Terms and conditions for services and purchases

Terms of service and purchase of the surf school.

  1. Scope and validity of the terms
  • The terms apply to legal relationships arising from the purchase of services through Surfmaster.ee (hereinafter Surfmaster) between all persons and the owner, Surf Master OÜ (registry code 16421614, VAT no.EE102712092) .
  • In addition to these terms, legal relationships arising from the purchase of services through Surfmaster are governed by the legislation in force in the Republic of Estonia.
  • Surf Master OÜ is entitled to amend and supplement these terms and the price list in accordance with the development of Surfmaster and in the interest of better and safer use of the website. Changes and additions to the terms and price list will be announced via the website www.surfmaster.ee. Changes and additions to the terms and price list enter into force upon publication of the respective change or addition on the website www.surfmaster.ee If you submitted your order before the changes to the terms entered into force, the terms in effect at the time you submitted the order shall apply to the legal relationship arising between you and Surf Master OÜ, unless otherwise provided by law or these terms.
  • The owner of the website surfmaster.ee (hereinafter the Website) is Surf Master OÜ.

 

Prices

2.1. Surfmaster prices apply if the invoice is paid by the due date in accordance with section 4.

2.2. All prices include the tax rates applicable in the Republic of Estonia.

2.3. The prices in the Surfmaster online store may differ from the prices of services available on-site at the Surfmaster surf school.

Shopping cart and placing an order

3.1. You can change the quantity of products in the shopping cart. You can also change the quantity of the service being ordered. While viewing the contents of your shopping cart, you can always return to the online store and select additional services.

3.2. After selecting the desired services, choose the preferred payment method and click “Place Order”. Now check again that all the information is correct and click “Confirm Order”. You will be redirected to the payment page.

3.2. On the customer information page, enter the required information.

3.3. Be careful when filling in the fields on the customer information and order confirmation pages, because the prompt and smooth processing of the service you purchased depends on the accuracy and correctness of this information.

3.4. The sales contract for services is deemed concluded (entry into force of the Contract) from the moment the purchase order is confirmed; therefore, when confirming the order in the online store, we consider the service confirmed by you to be purchased. By confirming the service, you agree to all the terms of the service and automatically undertake to pay the issued invoice.

Payment for services

4.1. You can pay for the services on the basis of the invoice issued in the online store or via bank link.

4.2. According to the terms of the contract, the amount of the purchase order must be paid to the bank account of Surf Master OÜ by the due date indicated on the invoice.

4.3. The full amount of the purchase order must be paid 100% before the service is provided.

Provision or delivery of the service:

5.1. After the Agreement enters into force  and payment has been made (in accordance with clauses 3.4 and 4.3 of the terms), the service can be redeemed at the Surfmaster surf school or at another location according to the service description and the reserved time.

5.2. The time of the service is reserved when placing the order, and Surfmaster assumes responsibility for the provision of the service according to the time indicated in the reservation. If weather or some other conditions are unfavorable for providing the service, the relevant information will be communicated to the customer and a new time for the service will be agreed upon. In such a case, the purchased service does not lose its validity. Due to the specific nature of the service, the service provider cannot guarantee suitable weather and other conditions, and when purchasing the service, the customer must take into account that changes to the service time may occur.

5.3 If the service provider has not notified the customer of a change in the service time, the service will be provided at the time reserved by the customer. If the customer does not arrive at the agreed time and agreed place, the service shall be deemed provided upon the expiry of the reserved time.

5.4. If the customer informs the service provider within a reasonable time, but no later than 24 hours before the service time, of illness or some other compelling reason, then a new time for the service shall be agreed upon. The service provider has the right to refuse to agree on a new time if no new times can be offered, there are no vacancies, or the service provider finds that the reason or circumstances are not sufficiently compelling.

5.5. For surf camps: If the customer notifies the service provider within a reasonable time, but no later than 4 days before the start of the surf camp, of a compelling reason affecting the customer (e.g. health problems or other unforeseen circumstances), the customer may: switch participation to another camp in the same season (if places are available) or exchange the service for another Surfmaster service in the same price range (e.g. training sessions, surf days) or, if desired, transfer participation to an equivalent surf camp next year, if the dates and programs for the next season have already been confirmed. The service provider has the right to refuse to offer a new time or service if: no suitable times are available, there are no more free places in the camps, or if, in the service provider’s assessment, the reason or circumstances are not sufficiently compelling or extraordinary.

5.6. When the customer comes to redeem the service, for faster service please print out the service invoice or present an electronic confirmation to the service provider.

5.7. If the order is cancelled at the Customer’s request, Surfmaster will not refund the money for the purchased service unless otherwise agreed. If the order is cancelled by Surfmaster, 100% of the total cost of the service will be refunded to the customer.

 

Surf Master OÜ is not liable for:

6.1. Physical injuries and damage to the customer’s property arising during the provision of the service.

6.2. All services are provided at the customer’s or the customer’s guardian’s own responsibility. Surf Master OÜ assumes no liability whatsoever for the customer’s injuries, death, or property damage.

    1. Customer responsibility

7.1. During the provision of the service, any material damage caused to Surfmaster due to the client must be compensated by the client immediately to the account of Surf Master OÜ or in cash. The material damage is assessed by the service provider immediately upon discovery of the damage. The amount of damage depends on the extent of the damage and the price of the product.

7.2. The client is not responsible for normal physical wear and tear of the product.

Liability and force majeure

8.1. Surf Master OÜ is liable to You and You are liable to Surf Master OÜ for damage caused to the other party by breach of these terms and conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.

    1. Other terms

9.1. All personal data of the client that becomes known during visits to the Surfmaster online store and making purchases is treated as confidential information. The encrypted data communication channel with banks ensures the security of the purchaser’s personal data and bank details. Surf Master OÜ also has no access to them.

9.2. Matters not separately resolved in these terms and conditions shall be governed by the legislation in force in the Republic of Estonia.

9.3. Disputes arising between You and Surf Master OÜ in connection with ordering and purchasing services through the Surfmaster online store shall be resolved through negotiations. If no agreement is reached, You have the right to обратиться to the Consumer Protection Board or the Court to protect Your rights. Disputes shall be resolved on the basis of the legislation in force in the Republic of Estonia.

Disclaimer

10.1 Images of the services are illustrative.

10.2 Service prices and availability may change without prior notice. In this case, Surf Master OÜ reserves the right to cancel the sale and refund the money to the customer’s bank account within 14 working days.

10.3 Surf Master OÜ reserves the right to cancel the sale if one of the following problems has occurred with the service: a human error occurred when entering the price or there was a technical error in the system (for example, if a service costing 50 EUR is suddenly on sale for 5 EUR, this is clearly an error. Consequently, we assume that the customer should understand that this is a mistake and the service is not for sale at such a price.)

10.4 Service information is checked and improved regularly. The data may have been updated since your last visit. Please always check the information before purchasing the service. If there are any inaccuracies in the service list or price, please also notify us by email at info@surfmaster.ee
